Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Ripple Roofing & Construction ("Company," "we," "us," or "our") concerning your access to and use of our website https://www.rippleroofs.com and our roofing services.

By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access our website or use our services.

Services Description

Ripple Roofing & Construction provides residential and commercial roofing services in Central Texas, including but not limited to:

  • Roof inspections and assessments
  • Roof installation and replacement
  • Roof repairs and maintenance
  • Emergency roofing services
  • Insurance claim assistance and documentation
  • Gutter installation and siding services
  • Storm damage restoration

All services are subject to availability, scheduling, and weather conditions. We reserve the right to refuse service at our discretion.

Estimates and Quotes

We provide free inspections and written estimates for roofing projects. Estimates are valid for 30 days unless otherwise specified and are subject to:

  • Physical inspection of the property
  • Material availability and current market pricing
  • Discovery of unforeseen conditions (rot, structural damage, code violations)
  • Changes in project scope requested by customer

Final pricing may vary if conditions differ from initial assessment. We will notify you of any material changes before proceeding with additional work.

Payment Terms

Payment terms are outlined in your written contract and typically include:

  • Deposit: A deposit may be required to schedule work and order materials
  • Progress Payments: Payments may be required at project milestones
  • Final Payment: Due upon completion and your satisfaction with the work
  • Financing: Third-party financing available (subject to credit approval)

Late payments may be subject to interest charges as permitted by Texas law. We accept cash, checks, credit cards, and financing through approved partners.

Warranties

Workmanship Warranty

We provide a 10-year workmanship warranty on all roof installations, covering defects in our labor and installation. This warranty covers:

  • Installation defects and workmanship errors
  • Leaks resulting from improper installation
  • Flashing and penetration failures due to installation
  • Improper fastening or attachment issues

Manufacturer Warranties

Roofing materials are covered by manufacturer warranties (typically 25-50 years for shingles, longer for metal and tile). Manufacturer warranties cover material defects but not improper installation (covered by our workmanship warranty). We register all manufacturer warranties on your behalf and provide you with documentation.

Warranty Exclusions

Warranties do not cover:

  • Normal wear and tear over time
  • Damage from severe weather events exceeding material ratings (tornadoes, hurricanes, extreme hail)
  • Damage from lack of maintenance or failure to perform recommended inspections
  • Modifications or repairs by other contractors without our approval
  • Structural failures not caused by our work
  • Consequential damages (interior damage, mold, personal property)
  • Damage from acts of God, fire, vandalism, or accidents
  • Algae, moss, or fungal growth (aesthetic only—does not affect performance)

Warranty Transfer

Our workmanship warranty may be transferred to a new homeowner if you sell your property. Transfer must be requested in writing within 30 days of sale. Some manufacturer warranties are also transferable—we provide documentation for warranty transfers.

Customer Responsibilities

You agree to:

  • Provide accurate property information and disclose known issues
  • Obtain HOA approvals if required
  • Provide access to property, electricity, and water during project
  • Protect or remove valuables and fragile items
  • Relocate vehicles and outdoor items from work areas
  • Keep pets secured during work hours
  • Maintain roof with recommended inspections and maintenance
  • Notify us promptly of any issues or concerns

Cancellation and Rescheduling

You may cancel your project with written notice. Cancellation terms:

  • Before materials ordered: Full refund minus $150 inspection/admin fee
  • After materials ordered: Refund minus material costs and restocking fees
  • After work begun: Refund minus completed work and materials used

We may reschedule due to weather, material delays, or unforeseen circumstances. We will communicate proactively and work to minimize delays.

Limitation of Liability

To the maximum extent permitted by Texas law, our total liability for any claims arising from our services is limited to the amount you paid for those services. We are not liable for:

  • Indirect Damages: Lost profits, business interruption, loss of data, or opportunity costs
  • Consequential Damages: Interior water damage, mold remediation, temporary housing, or personal property damage not directly caused by our negligence
  • Punitive Damages: Except where prohibited by law
  • Acts of God: Tornadoes, hurricanes, floods, earthquakes, or other natural disasters beyond our control
  • Third-Party Actions: Damage caused by other contractors, utility companies, or unauthorized persons

We maintain comprehensive general liability insurance and workers' compensation coverage as required by Texas law. You may request certificates of insurance at any time.

Insurance Coverage: General Liability ($1,000,000 per occurrence / $2,000,000 aggregate), Workers' Compensation (Texas statutory limits), and Commercial Auto Liability. All policies are current and verified.

Force Majeure

We are not liable for delays or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: severe weather conditions, natural disasters, acts of God, government restrictions, material shortages, labor disputes, pandemics, or other emergencies. In such cases, we will notify you promptly and reschedule work as soon as reasonably possible. You will not be charged for delays caused by force majeure events.

Permits and Code Compliance

We obtain all necessary permits for work we perform and ensure compliance with applicable building codes in your jurisdiction. Permit costs are included in your project estimate unless otherwise specified. We coordinate all required inspections and provide you with copies of:

  • Building permits
  • Inspection certificates
  • Certificate of completion (if required)
  • Warranty registration documentation

You are responsible for obtaining HOA approvals if applicable. We can assist with HOA documentation and provide specifications for your submission.

Subcontractors and Third Parties

We may use qualified subcontractors for specialized portions of your project (e.g., HVAC work, electrical, structural engineering). All subcontractors are licensed, insured, and supervised by our project managers. We remain fully responsible for the quality of all work performed, whether by our employees or subcontractors. You will be notified if subcontractors will be working on your property.

Dispute Resolution

We are committed to resolving any disputes amicably and professionally. If a dispute arises:

  1. Direct Communication: Contact us immediately at (512) 763-5277 or info@rippleroofs.com to discuss the issue. Most disputes are resolved through open communication.
  2. Investigation: We will investigate your concern thoroughly and respond within 3 business days with our findings and proposed resolution.
  3. Mediation: If direct communication does not resolve the dispute, both parties agree to participate in good-faith mediation before pursuing litigation. We will share the cost of mediation equally.
  4. Arbitration Option: Either party may request binding arbitration through the American Arbitration Association (AAA) under its Construction Industry Arbitration Rules. Arbitration will be conducted in Williamson County, Texas.
  5. Litigation: If mediation and arbitration are unsuccessful or declined, any legal proceedings will be governed by Texas law and held in Williamson County, Texas. You agree to the exclusive jurisdiction of the courts in Williamson County.

Attorney's Fees: In any legal proceeding, the prevailing party shall be entitled to reasonable attorney's fees and costs as permitted by Texas law.

Indemnification

You agree to indemnify and hold harmless Ripple Roofing & Construction, its owners, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from:

  • Your breach of these Terms
  • Your violation of any law or regulation
  • Your violation of third-party rights
  • Inaccurate information you provide about your property
  • Your failure to obtain required HOA or other approvals
  • Accidents or injuries caused by your failure to secure pets or provide safe access

This indemnification does not apply to claims arising from our negligence or willful misconduct.

Texas Construction Law Compliance

We comply with all Texas construction laws and regulations, including:

  • Mechanic's Lien Rights: We reserve our rights under Texas Property Code Chapter 53 for unpaid work
  • Retainage: Retainage requirements comply with Texas Property Code §28.001
  • Payment Terms: All payment terms comply with Texas prompt payment statutes
  • Licensing: We maintain all required state and local licenses
  • Insurance: We carry insurance as required by Texas law
  • Notices: We provide all notices required by Texas law (mechanic's lien notices, substantial completion, etc.)

Website Use and Intellectual Property

All content on our website (text, images, logos, designs) is owned by Ripple Roofing & Construction or licensed to us. You may not:

  • Copy, reproduce, or distribute our content without permission
  • Use our trademarks or branding without authorization
  • Scrape, data mine, or use automated tools on our website
  • Attempt to hack, disrupt, or compromise our website security

Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
